Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/10/2016 Though number of grounds have been raised in this petition, learned counsel for the petitioner presses only one ground that the petitioner has been transferred whereas the petitioner is going to retire within a period of less than one year i.e. on 01/06/2017.

Learned counsel for the petitioner submits that the policy of transfer states that where the Government employee is going to retire within a period of one year, he may be posted either in his home district or at a place of his option as provided in Clause 2.10 of circular dated 11/06/2016.

In view of the aforesaid policy of the Government, it would be proper to direct the respondents to consider petitioner's case, whether the petitioner could be adjusted in the home district or at a place of his option, subject to exigencies of
service.

If the petitioner submits representation within a period of three weeks from today, the same shall be considered by the authorities within a period of four weeks. For a period of six weeks, the petitioner shall be allowed to continue at the present place of posting.

The petition is accordingly disposed off.
