1. Perusal of the record of the court below shows that the appellant was convicted under Section 307 IPC and sentenced to undergo R.I. for seven years and fine of Rs.1000/- in default additional R.I. for two months was awarded. The appellant was in jail for 77 days during trial and thereafter on 30.07.2007 he was taken into custody and was sent to jail thereafter the bail was preferred. Appellate Court order shows that the appellant was not enlarged on bail, thereby in any eventuality he must have suffered the entire jail sentence as he is in jail since 30.07.2007.

2. Despite repeated calls, none appears nor any representation is made on behalf of the appellant to prosecute this appeal on merits.

3. Consequently, the appeal is dismissed as infructuous as the appellant has already suffered his entire jail sentence.
