Learned counsel for the respondents No.1 & 2 submits that the instant petition was against issuance of notice under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 to the petitioner who was guarantor to one Avdesh Agrawal proprietor of M/s Auto Care. He made default in payment of loan. Learned counsel submits that account of M/s Auto Care has been settled. In view of such submission, since account has been settled, petition has become infructuous.
