1. The grievance of the Petitioner is non-granting of promotion to the post of Teacher (Panchayat) from the post of Assistant Teacher (Panchayat).

2. According to the Counsel for the Petitioner the dispute in the present writ

petition already stands adjudicated upon by the Division Bench of this Court in Writ Petition(S) NO. 4794 on 15.09.2016 directing the Respondents to consider representation of the Petitioner by passing a speaking order so far as claim for promotion to the post of Teacher(Panchayat) is concerned, within a period of six months from the date of receipt of representation and prays for a similar order be passed in the present case also.

3. He further submits that the Petitioner has till date not filed his representation before the Respondents.

4. Learned State Counsel after verification of facts of the case submits that the case of the present Petitioner is identical in nature and may be disposed off in similar terms.

5. It is accordingly directed, subject to the Petitioner filing fresh representation to the Respondent within a period of four weeks from today, the Respondent shall pass an appropriate order in accordance with the direction given by this Court in Writ Petition (S) No. 4794/2016 within a further period of six months from the date of presentation of Order of this Court and the representation.

6. It is made clear that this Court has not expressed anything on merits of the case and the case of the Petitioner shall be considered and decided fully in accordance with the rules governing the field.
