1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.124/2015, registered at Police Chowki Dabra, Police Station Rajpur, Distt. Balrampur-Ramanujganj, for the offence punishable under Sections 279, 337, 304A of the IPC and 34

(2) of the Chhattisgarh Excise Act, 1915.

2. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the provisions contained in Section 59A (ii) of the Chhattisgarh Excise Act, 1915 and recovery of huge quantity of liquor i.e. 117.60 bulk litres, I am not inclined to grant regular bail to the applicant. The application is rejected.
