1. This second application under Section 438 of Cr.P.C. has been preferred by the applicant apprehending his arrest in connection with Crime No.53/2015, registered in Police Station -Saria, District- Raigarh, for alleged commission of offence under Sections 20 (B) of the NDPS Act. His earlier application for anticipatory bail has been rejected on 8.9.2015.
2. Learned counsel for the applicant would submit that the applicant is not involved in the incident. Earlier bail application was rejected on the ground that the Driver is absconding. Learned counsel for the applicant would submit that till date, the Driver has not been arrested, therefore, at this stage, applicant may be protected by granting him anticipatory bail.
-23. Having considered the submissions made by learned counsel for the applicant and the order passed by this Court earlier where these submissions were already considered and application was rejected, I am not inclined to grant anticipatory bail to the applicant.
4. The application is accordingly rejected.
