1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.225/2015 (Special Case No.5/2015 pending in the Court of Special Judge under the NDPS Act, Bemetara), registered at Police Station Bemetara, Distt. Bemetara, for the offence punishable under Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Case of the prosecution, in brief, is that the applicant was found in possession of 2.5 Kgs. of contraband article Ganja.

3. Taking into consideration the nature and gravity of offence, facts and circumstances of the case and quantity of Ganja i.e. 2.5 Kgs., I am not inclined to grant regular bail to the applicant. Consequently, the application is rejected.
