The limited prayer which the petitioner in the present writ petition has made is for a direction to the respondent No. 3 to consider and decide the departmental appeal which the petitioner has been made.

The State counsel does not oppose the same.

Counsel for the petitioner at this juncture also prayed that the petitioner also permitted to make a supplementary appeal to the appellate authority as he has to bring certain further facts to the notice of the appellate authority.

Given the aforesaid facts and circumstances of the case and also contents of the pleading in the present writ petition this Court is of the opinion that no fruitful purpose would be served if the petition is

-2kept pending rather ends of justice would meet if the present writ petition is allowed and disposed off with the liberty within a period of two weeks from the date of receipt of certified copy to the petitioner to make a supplementary appeal to the respondent No. 3 thereafter, the appellate authority should decide the appeal within a further period of 90 days from the receipt of the supplementary representation of the petitioner.
