22.02.2021 Heard on the prayer for condonation of delay.

2. Taking into consideration the ground for condonation of delay and the explanation offered, we are inclined to condone the delay. Accordingly, the application is allowed and the delay is condoned.

3. Taking into consideration the submission of learned State counsel that despite there being very strong incriminating circumstances of the body of the deceased found in the house of the accused and that it is a case of homicidal death due to assault, and further that there being no explanation on the part of the accused as to how the body of the deceased was found in his house by homicidal death, acquittal

has been ordered, we are inclined to grant leave to appeal. Application is accordingly allowed.

4. Let the appeal filed by the State be registered as Acquittal appeal and be listed for further orders.

5. CRMP is accordingly disposed off.
