The present petition under Section 482 of CrPC has been filed by the Petitioner with a limited prayer that Criminal Appeal No. 48 of 2015 which has been filed before the Court of First Additional Sessions Judge, Sakti, District Janjgir-Champa is pending consideration since long and the same may be decided expeditiously.

According to the Counsel for the Petitioner, the said appeal before the First Additional Sessions Judge, Sakti is getting adjourned only on account of the fact that the original records of the case has not reached the lower Appellate Court from the Court of Judicial Magistrate First Class, Sakti which is at the same station.

Considering the total facts and circumstances of the case, the present petition is disposed of with a direction to the First Additional Sessions Judge, Sakti to ensure that the appeal is taken up on priority basis and make all endevours for an expeditious disposal of the appeal. The First Additional Sessions Judge, Sakti should also look into the matter
-2as to why so much of time is being consumed for not receiving the records from the Magistrate Court within the same station. Let a copy of this order be also sent to the District Judge, Janjgir-Champa who shall also take appropriate steps in this regard.
