The applicant has been arrested on 03/10/2016 in connection with Crime No.380/2016 registered at Police Station - Masturi, District - Bilaspur (CG) for alleged commission of offences under Section 342, 34 of IPC and Section 11, 12 of the Protection of Children from Sexual Offences Act, 2012. 2.
Case of the prosecution is that the applicant along with other co-accused were calling young boys less than 18 years and they have been subjected to unnatural offences.

Learned counsel for the applicant submits that the applicant has not committed any offence. Merely because the place where offence is alleged to have been committed, belong to the applicant and relations are of the applicant, the applicant has been involved.

On the other hand, learned State counsel opposes the bail application and submits that looking to the nature of allegations and that more than one young boys, less than 18 years of age were subjected to unnatural offence, the applicants are not entitled to grant of bail.

Taking into consideration the nature of allegations, number of boys, less than 18 years alleged to be victims of repeated act of unnatural offence, I am not inclined to grant bail to the applicant. The application is therefore rejected. Sd/- ( Manindra Mohan Shrivastava ) Judge Deepti
