Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 26/10/2016 Heard on admission.
1. Transfer order is under challenge mainly on the ground that if the petitioner is transferred outside the district, his seniority may be affected.
2. Learned counsel for the State submits that the transfer order of the petitioner shall not adversely affect petitioner's seniority. He submits that in the transfer order, it is nowhere written, therefore, the apprehension that seniority would be affected does not have any factual foundation.
3. In view of the above submission of learned counsel for the State that the
-2seniority will not be adversely affected, on this ground, I am not inclined to interfere with the transfer order. However, considering that the petitioner is a Class-IV employee and that he has made representation, his representation on personal grounds ,which have referred to in the representation, may be considered and decided by the competent authority within a period of 4 weeks from the date of receipt of copy of this order.
