This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.40/2020, registered at Police Station Tumgaon, District Mahasamund (CG) for the offence punishable under Section 34(2) of the CG Excise

MCRC No. 2270 of 2020 Act, for illegally possessing 53.280 liters of country made liquor. 3.

Having heard learned counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicants are in jail since 1.4.2020, this Court is inclined to release them on bail.

Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1,00,000/- with one local surety each in the like amount to the satisfaction of the concerned on duty remand Magistrate. They are directed to appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicants involve themselves in the offence of similar nature in future, this order granting bail to the applicants shall automatically stand cancelled without further reference to the Bench.
