1. Shri Kamlesh Kumar Pandey, Counsel for the appellant submits that the appellant wants to withdraw this appeal with liberty to avail alternative remedy available to him.

2. Accordingly, FAM No. 228/2016 is dismissed as withdrawn with the aforesaid liberty granted in favour of the appellant.

3. Counsel further submits that Registry be directed to return the certified copy of the impugned judgment after accepting a photocopy of this order.

4. Ordered accordingly.

5. In the eventuality of furnishing a photo copy of the impugned judgment, Registry shall return the certified copy of the impugned judgment.
