1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.46/2020 registered in Police Station Gunderdhehi, District Balod for offence punishable under Section 323 and 327 of the IPC.
2. Case of the prosecution is that the complainant lodged a written complaint stating that the applicant has assaulted him on the basis of which the police has registered the crime and the applicant has been arrested.
3. Counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in the crime.
4. On the other hand, learned State Counsel has opposed the bail application.
5. Having heard learned counsel for the parties and having regard to the facts and circumstances of the case, this Court is inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1 lakh with one surety for the like amount to the satisfaction of the concerned on duty remand Magistrate.
