Sam Koshy Order On Board 28/03/201 This is the second bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who is in jail since 26.02.2018 in connection with Crime No. 27/2018 registered at Police Station- Gandhinagar, TahsilAmbikapur, District Surguja (CG) for the offence punishable under Sections 376, 452 & 506 of IPC.

The earlier bail application stood dismissed as withdrawn with liberty to revive the same after the prosecutrix is examined vide order dated 26.04.2018 passed in MCRC No. 1949 of 2018. 3.

The repeat bail application now has been filed after the prosecutrix has been examined.

Perusal of the record would show that it is not a case where the prosecutrix has turned hostile and has not supported the case of the

prosecution. Given the said fact, this Court is not inclined to release the applicant on bail at this juncture.

Accordingly, the present application for grant of bail stands rejected. However, the trial Court is directed to ensure that the remaining witnesses are promptly called upon and examined and the trial is concluded at the earliest.
