The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.203/2020, registered at Police Station Kotwali, Ambikapur, District Surguja (C.G.), for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act for illegally possessing 32 litres mahua liquor.

Having heard learned counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicant is in jail since 10.04.2020, this Court is inclined to release her on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.1,00,000/- with one local surety in the like amount to the satisfaction of the concerned on duty remand Magistrate. She is directed to appear before the trial Court on each and every date given by the said Court. It is made
clear that if the applicant involves herself in the offence of similar nature during the operation of this order, this order granting bail to the applicant shall automatically stand cancelled without reference to the Bench and the applicant shall be arrested forthwith.
