This is the second bail application. The first bail application was dismissed as withdrawn on 21.04.2014.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.292/2013 registered at Police Station- Kharsia, District Raigarh, for offence punishable under Sections 376 (2) (G), 302, 201/34 of I.P.C.

Learned counsel for the applicant vehemently argued that despite the charge sheet has been filed on 03.10.2013, the trial is not concluded. He would further submit that the applicant is in jail since 09.07.2013 and would submit that under these circumstances, the applicant may be enlarged on bail.

Per contra, the learned State counsel opposes the prayer for grant of

Having regard to the fact that the first bail application was dismissed as withdrawn on 21.04.2014 and I do not find any change of circumstance at this stage, therefore, I am not inclined to enlarge the applicant on bail. However, considering the fact that the applicant is in jail since 09.07.2013, the trial Court is requested to expedite the trial as early as possible.
