1. Heard.
2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.P-8 142/2020 (as per rejection order of the Court below), registered at Police Station Excise Circle Dallirajhara, District Balod (CG), for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act for illegally possessing 35 bulk liters of country made liquor.
3. Having heard learned counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicant is in jail since 30.03.2020, I am of the
opinion that present is a fit case to release the applicant on regular bail.
4. Accordingly, the bail application M.Cr.C.No.2236 of 2020 is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- with one local surety in the like amount to the satisfaction of the concerned on duty remand Magistrate. He is directed to appear before the trial Court on each and every date given by the said Court.
5. It is made clear that if the applicant involves himself in the offence of similar nature during the operation of this order, this order granting bail to the applicant shall automatically stand cancelled without reference to the Bench and the applicant shall be arrested forthwith.
6. Consequently, I.A.Nos.1 & 2 stand disposed of.
