1. Heard.

2. The applicants have preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as they were arrested in connection with crime No.87/2020 registered in Police Station Khairagarh District Rajnandgaon (C.G.) for the offence punishable under Section 34(2) of the Excise Act for illegally possessing 8.64 liters of country made liquor.

3. Learned counsel for the State would oppose the prayer.

4. Considering the fact that the offence is triable by the Judicial Magistrate First Class and further considering the fact that the applicants are in jail since 15-3-2020, I am of the opinion that present is a fit case to release the applicants on regular bail.

5. Accordingly, the bail application M.Cr.C.No.2230 of 2020 is allowed and the applicants are directed to be released on bail on their executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the concerned on duty remand Magistrate. They are directed to appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicants involve themselves in the offence of similar nature during the operation of this order, this order granting bail to the applicants shall automatically stand cancelled without reference to the Bench and the applicants shall be arrested forthwith.

6. Consequently, I.A.No.1, application for urgent hearing during outbreak of COVID-19 pandemic, I.A. No.2 and I.A. No.3 stands disposed of.
