1. Heard.

2. The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as she was arrested in connection with crime No.204/2020 registered in Police Station Kotwali Ambikapur, District Sarguja (C.G.) for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act for illegally possessing 8 liters of country made liquor.

3. Learned counsel for the State would oppose the prayer.

4. Considering the fact that the offence is triable by the Judicial Magistrate First Class and further considering the fact that the applicant is in jail since 10.04.2020, I am of the opinion that present is a fit case to release the applicant on regular bail.

5. Accordingly, the bail application M.Cr.C.No.2234 of 2020 is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the concerned on duty remand Magistrate. She is directed to appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicant involves herself in the offence of similar nature during the operation of this order, this order granting bail to the applicant shall automatically stand cancelled without reference to the Bench and the applicant shall be arrested forthwith.

6. Consequently, I.A.No.01, I.A. No.02 and I.A. No.03 stand disposed of.
