1. Heard.

2. This is the first bail application preferred by the applicant under Section 439 of Cr.P.C. for grant of bail, as he has been arrested in connection with Crime No.73/2021, registered at Police Station Dipka, District- Korba (C.G.) for the offence punishable under Sections 279, 337, 304-A, 304, 308/34 of the Indian Penal Code.

3. The applicant alongwith co-accused Prakash Kumar Kosle, Vikas Tandon, Pankaj Kumar Banjare and Hemant Banjare were traveling in a Hyundai Verna (unregistered car) driving the same in a rush and negligence manner and caused accident causing death of Chandralekha Sahu and injuring Sushila Upalwar.

4. Learned State counsel would submit that the applicant was driving the vehicle and the deceased and injured as well were on their side of the road, yet the applicant dashed against them to commit death of Chandralekha sahu.

5. Considering the entire facts situation of the case and for the fact that the applicant is in jail since 13-03-2021; the charge sheet has already been filed, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
