The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.131/2020, registered at Police Station Kharora, District Raipur (CG), for the offence under Sections 420, 406/34 of the IPC and Sections 4 & 6 of the Prize Chits and Money Circulation Schemes Act and
MCRC No.2806 of 2021 Section 10 of the Chhattisgarh Nikshaepakon Ke Hiton Ka Sarankshan Adhiniyam, 2005.

The first bail application was dismissed by mentioning that similarly placed co-accused Poshan Dewangan has been refused bail by this Court in MCRC No.4834 of 2020 vide order dated 17-9-2020.

Applicant and other co-accused obtained deposits of Rs.48,05,980/- from different persons on assurance of doubling the amount within 15 days, but thereafter even the original amount has not been paid to them.

Considering the entire facts situation of the case and for the fact that the co-accused Poshan Dewangan has now been released on bail by a coordinate bench of this Court vide order dated 24-3-2021 in MCRC No.1835 of 2021; and also considering the fact that the applicant is in detention since 28-5-2020 i.e. for more than one year, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
