Versus
1. State of Chhattisgarh through its Secretary, Department of Panchayat and Rural Development, Chhattisgarh Rajya Mantralaya, Mahanadi Bhavan, P.S. Mandir-Hasaud, Naya-Raipur (C.G.)
2. Additional Secretary, Department of Panchayat and Rural Development, Chhattisgarh Rajya Mantralaya, Mahanadi Bhavan, P.S. Mandir-Hasaud, Naya-Raipur (C.G.)
3. Chief Executive Officer, Zila Panchayat of Mahasamund, District - Mahasamund (C.G.) ---- Respondents -------------------------------------------------------------------------------------------------------- For Petitioner :
Mr. Pallav Mishra, Advocate For State :
Mr. B. Gopa Kumar, Dy. Advocate General ------------------------------------------------------------------------------------------------------ Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 07/11/2016 Heard.
1.
The petitioner has challenged the order dated 26.07.2016, by which he has been transferred. It is found that a proposal for cancellation of impugned transfer order has been made on 28.09.2016 by the Chief Executive Officer, Janpad Panchyat, Basna. It appears that the matter is of the administrative consideration.
2.
The petitioner has challenged the impugned transfer order before this Court after more than three months, in the mid session, therefore, only on that ground, I am not inclined to invoke extra ordinary jurisdiction under Article 226 of the Constitution of India. Leaving it open for the respondents to take into consideration the administrative matters as per letter dated 28.09.2016 of the Chief Executive Officer, Janpad Panchyat, Basna, this petition is dismissed.
