Shri Rajeev Bharat, Advocate for respondent No.2. Shri Q. Aziz, Advocate for respondent No.3 Heard on I.A. No.1/18, an application for condonation of delay in filing this appeal as the same has been filed with a delay of 1638 days.

On 3.4.2018 this Court issued notices to respondents on I.A. No.1/18, but none of the respondents has filed reply to this application.

Though this Court is not convinced with the reasons assigned in application seeking condonation of delay, but keeping in mind the fact that the Motor Vehicles Act, 1988 is a benevolent piece of legislation and that it is the duty of the Courts/Tribunals to see that claimant/victim are awarded just and fair amount of compensation, and also considering that claimant/appellant, who is aged about 19 years, has suffered 100% permanent disability and appeal of insurance company challenging impugned award is pending consideration, I.A. No.1/18 is allowed and delay of 1638 days in filing this appeal is condoned.

Heard on admission.

Appeal is admitted for consideration.

As this appeal is already listed in list of final hearing cases along with other connected appeals, therefore, with the consent of the parties, the same is also heard finally along with other connected appeals.
