Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 08/11/2016 Heard on admission.

The impugned transfer order was earlier challenged before this Court in a writ petition which was finally disposed off vide order dated 05.07.2016 to consider the matter in view of policy of keeping husband wife together as far as possible at one or nearby station. Thereafter, the

-2representation of the petitioner was considered and vide order dated 19.08.2016, the representation of the petitioner has been rejected on certain administrative grounds.

Learned counsel for the petitioner submits that the petitioner has now again made a representation on 30.09.2016 for transferring the petitioner to some other school which is nearer to the posting of the petitioner's wife.

It appears that the petitioner has remained posted at the present place of posting under transfer order dated 18.04.2016. The petitioner, at this stage, has again made a fresh representation on certain new grounds.

In the mid session, now, I am not inclined to issue any direction. However, it will be open for the competent authority to take appropriate decision in the matter and it is made clear that the order passed by this Court earlier shall not come in the way of the authority. 5.

The petition is finally disposed off.
