The challenge in the present writ petition is non consideration of the petitioner for appointment to the post of Lecturer Panchayat on the ground that the petitioner did not have the requisite educational qualification on the date of advertisement.

The counsel for the petitioner submits that so far as the course of B.Sc Maths which the petitioner had participated, she had passed only on 01.08.2017 i.e. after advertisement was published but before the last date.

Now so far as cut off date is concerned it is well settled legal position that in case if the cut off date is given in the advertisement and thereafter if the candidature of a person has been rejected on the ground that the candidate is not having the requisite educational

-2qualification on the cut off date i.e. the date of advertisement, the same cannot said to be either erroneous or contrary to law. 4.

In the instant case, admittedly, from the contents of the Writ Petition itself it would reveal that the petitioner on the date of advertisement did not passes the qualification of B.Sc Mathematics. 5.

Thus, the publication holding of the petitioner as an ineligible candidate is proper and cannot be said to be bad in any manner. 6.
