There is an application for modification of order passed by this Court earlier on 21-09-2015.

It has brought to the notice of this Court that the Rent Controlling Tribunal has now become functional and at the time, when the instant petition was filed, the petitioner was not having alternative remedy. 4.

In view of above, this petition is finally disposed off with liberty to the petitioner to file an appeal before the Rent Controlling Tribunal within a period of 30 days. The interim order was passed by this Court in the present matter, in which, the petitioner has sought certain clarification and modification.

At this stage, I am not inclined to pass further order in the matter. The case is now to be looked into by the Rent Controlling Tribunal. The petitioner may move appropriate application before the Rent Controlling Tribunal in the matter of payment of rent and also in the matter of stay.

Certified copy of the impugned order (Annexure P-1) be returned, after retaining photocopy of the same.
