This is second round of litigation.

Earlier the petitioner had filed a petition aggrieved by the transfer order and the petition was disposed off by this Court with

-2the direction to consider representation. The representation of the petitioner has been rejected giving rise to this petition. 3.

Learned counsel for the petitioner submits that the petitioner is not surplus, he is aged about 57 years, therefore, he should not have been sent to a scheduled area and that if he is not posted at or near the place where his wife is posted, he will suffer grave hardship.

The impugned order shows that the petitioner has remained posted at the present place for the last about 18 years. Therefore, on this count, there is sufficient exigency to transfer the petitioner without any other aspect. Therefore, I am not inclined to interfere with the impugned order.

The petition is therefore dismissed.
