Versus

1. The State Of Chhattisgarh Through Its Secretary, Public And Health Engineering Department, Mantralaya Mahanadi Bhawan, Naya Raipur Distirct Raipur Chhattisgarh

2. Executive Engineer, Public And Health Engineering Department, Dhamtari Chhattisgarh

3. Assistant Engineer, Public And Health Engineering Department Sub Block Kurud, Distirct Dhamtari Chhattisgarh ---- Respondents ---------------------------------------------------------------------------------------------------------- For Petitioner :

Mr. Parag Kotecha, Advocate For State :

Mr. R.K. Gupta, Dy. Advocate General ---------------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 11/11/2016 Heard.

1.

The transfer order dated 29.07.2016 is under challenge on the ground that the petitioner has already served in the scheduled area continuously for two years, but he has not been considered to transfer outside the scheduled area. It is also submitted that the petitioner is a Class-IV employee and by transfer to the another district he would have to suffer serious hardship.

2.

The transfer order was passed on 29.07.2016 whereas this petition has been filed, as late as, on 07.11.2016, therefore, I am not inclined to interfere with the impugned order in exercise of supervisory jurisdiction under Article 226 of the Constitution of India. Nevertheless, the petitioner would be at liberty to make representation before the respondents raising all grievances as and when the next transfer season ensues, the representation of the petitioner shall be considered. 3.

The petition is accordingly disposed off.
