Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 07/08/2019 Heard.

1. This contempt petition has been filed alleging willful disobedience of the order dated 02.04.2018 passed by this Court in WPS No. 460 of 2005.

2. Referring to the operative part of the order as contained in paras 18 and 19 thereof, learned counsel for the respondents would submit that the arrears which were found due according to the respondents have been not only worked out but paid also. Detail in this regard has been contained in the reply filed by respondents in paragraphs 4 to 7.

3. After going through the same, I find that towards compliance of the direction issued by this Court, notional promotion, notional fixation and revision of

salary as also pension has taken place and the arrears worked out has also been released in favour of the petitioner.

4. Learned counsel for the petitioner would submit that there may be claim of the petitioner regarding proper computation.

5. After having gone through the reply on affidavit and the exercise undertaken by the respondent, I am satisfied that the respondents have worked out the dues liable to be paid to the petitioner in the light of the direction issued by this Court and various dues have also been paid. In the order passed by this Court, no exact amount was quantified. In case, the petitioner has grievance that under any particular head appropriate computation has not taken place, it would be open for the petitioners to bring it to the notice of the competent authority.
