Hon'ble Shri Justice P. Sam Koshy Order On Board 13.04.2021

1. The limited relieve that the petitioner seeks at this juncture is for an appropriate direction to the respondent to consider and decide the representation of the petitioner seeking for re-joining on post of Patwari.

2. According to the counsel for the petitioner identically placed persons who has approached this Court on an earlier occasion by virtue of an interim protection of this Court were permitted to clear all the examinations and have also been granted regular posting by the department, therefore, on the

ground of parity the petitioner case should also be considered and they should not be left out only for the reasons that they did not approach the Court on an earlier occasion. The counsel for the petitioner submits that similarly placed persons in District - Surguja have also been granted joining by the department after clearing their requisite examination.

3. State counsel submits that since the representation are pending consideration the authority shall consider and decide in accordance with law at the earliest.

4. Given the submission by the counsel on the either side, the petitioner at this juncture shall disposed off directing the Respondents No. 2 to 4 to take a appropriate decision on the representation of the petitioner keeping in view other identically placed persons appointed along with the petitioner at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
