Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/04/2018 This petition has been filed by the petitioner on account of grievance that the respondents are proceeding illegally by giving promotion on the basis of provisional seniority list of 01/04/2017 in the matter of promotion to the post of Lecturer Panchayat, Biology.

Learned counsel for the petitioner submits that the petitioner is entitled to be considered for promotion on the basis of seniority list which was prevalent prior to 01/04/2018 and not 01/04/2017. It is submitted that the petitioner has preferred representation for consideration but the same has not been decided. 3.
Considering the submission of learned counsel for the parties, at this stage, it would be proper to direct the Chief Executive Officer, Jila Panchayat, Kabirdham to examine the representation of the petitioner in the light of the rules and take a
decision thereon. The representation of the petitioner shall be decided, if not already decided, by a speaking order within a period of three weeks and thereafter, the respondents would be at liberty to proceed with the promotion matters. 4.
In case, the petitioner is not satisfied with the order, if any passed, he would be at liberty to file appeal under Chhattisgarh Panchayat (Appeal and Revision) Rules, 1995. The petition is accordingly finally disposed off. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
