Learned counsel appearing for the appellant submits that the appellant in the instant case-M.D. Prabhu has since expired on 26.10.2016. Copy of death certificate of appellantM.D. Prabhu has already been brought on record. In view of fact that sole appellant has died as early as on 26.10.2016 and no near relatives of the appellant have come up for contesting the appeal, the appeal stands abated. Accordingly, the appeal is dismissed as stands abated.
