Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/11/2016 The petitioner has filed this petition aggrieved by order dated 04/11/2016 of the Revisional Court. The allegation against the petitioner is that the petitioner was running a clinic and prescribing Allopathic medicine though he is not a duly qualified MBBS doctor.
The learned Trial Court rejected the application for removing lock and seal which was affirmed by the Revisional Court also, considering that the matter is under investigation.

It is found, by that time, the Revisional Court rejected the revision taking into consideration that the matter remained under investigation. The reason assigned by the Court below to reject the application for removal of lock and seal appears to be justified taking into consideration the nature of allegations and that the investigation was not complete by that time. However, taking into consideration that now, investigation is complete and charge sheet has been filed, the Trial Court is directed to consider petitioner's application for removal of lock and seal from the premises taking into consideration the subsequent
development of filing of the charge sheet. If the petitioner submits application before the Trial Court, the same shall be considered and decided within four days from the date of receipt of application.
