1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.4/2021 registered in Police Station Pasan, Distt. Korba C.G. for the offence punishable under Section 420/34 of the I.P.C.

2. As per the prosecution case, complainant Channa Ramkrishna lodged a report to the effect that present accused Krishna Gond assured him of providing gold at low price and took him along with Channa Ramkrishna's father

MCRC No. 2768 of 2021 and Akanapalli Ashok to village Pipariya where another person and one lady came with a bag containing Rs. 7 Lakh in exchange for 5 pieces of gold biscuits which were later on found to be fake, made up of brass. Admittedly, co-accused Smt. Rajkumari has already been released on anticipatory bail bearing MCRCA No.127/2021.

3. Learned State counsel would oppose the prayer for grant of anticipatory bail.

4. Considering the entire fact situation of the case and for the fact that this applicant is in jail since 06.1.2021 and the offence is triable by JMFC, I am inclined to release the present applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
