Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 29/11/2016

1. The applicant has been arrested in connection with Crime No. 211 of 2014 registered in Police Station- Sonhat, District- Korea (C.G.) for the alleged commission of offence under Sections 506, 363, 366 and 376 (2) (t) (>) IPC, Section 5 (B) / 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 3 (2) (5) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989.

2. It is found that in the present case, the trial is at the verge of conclusion and only one prosecution witness remained to be examined. In that view of the matter, I am not inclined to grant bail to the applicant at this stage as there does not appear to be a case of undue delay in trial.

3. Considering the nature and gravity of allegation, the application, at this stage, is disposed off with liberty to revive in case trial is not concluded within a further period of 3 months./- Sd/- (Manindra Mohan Shrivastava) Judge Praveen
