----------------------------------------------------------------------------------------------- Hon'ble Shri Justice Manindra Mohan Shrivastava Order on Board 11/04/2018 1.
This petition has been filed by the petitioner alleging willful disobedience of the order dated 06-10-2017 whereby the Court, allowing petition, had directed the respondents in the writ petition to consider petitioner's claim for compassionate appointment strictly in accordance with the policy dated 14-06-2013. Though, the order was passed wayback on 06-10-2017, even after lapse of 5 months, there is no consideration despite repeated representation made and copy of the order of the Court placed before the concerned Superintendent of Police. 2.
Even though, there is no time limit prescribed for compliance of the order, it is required to be complied with within a reasonable time. Five months are enough within which the decision ought to have been taken. Before initiating contempt proceedings, this Court would like to observe that if the decision is not taken within further period of 45 days from the date of receipt of copy of this order by respondent No. 2, contempt proceedings may be initiated for willful disobedience of the order of the
Court.
3.
Accordingly, the petition is disposed off with liberty to revive, in case, grievance is not redressed.
