1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.79/2020 registered at Police Station Kota, Out Post Belgahna, District Bilaspur (CG) for the offence punishable under Sections 326, 427, 147, 148, 149, 294, 323 of the IPC.

3. As many as eight accused persons assaulted four injured persons including Laxman Rajput, who has sustained grievous injury caused by applicant No.2 Ramprasad Sahu . This applicant inflicted cut wound on small finger of the right hand of injured Laxman Rajput. As against two other applicants, there are general allegations that they too participated in assaulting the injured persons.

4. Considering the nature of allegations and the injury caused by applicant No.2 Ramprasad Sahu, this Court is not inclined to release him on bail at this stage.

5. Accordingly, the bail application of applicant No.2 Ramprasad Sahu is dismissed. However, he would be at liberty to repeat his prayer after examination of injured Laxman Rajput.

6. At the same time, applicant No.1 Lalji Sahu and applicant No.3 Bhagwani Sahu are not found to have caused any serious injury to any of the injured persons, therefore, their bail applications are allowed.

7. Accordingly, applicant No.1 Lalji Sahu and applicant No.3

Bhagwani Sahu are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
