The petitioner has filed this contempt petition alleging willful disobedience on the ground that though, this Court has stayed the effect and operation of the suspension order, the departmental proceeding is continued against the petitioner and the petitioner is compelled to participate and file reply.

In the writ petition filed by the petitioner, the only issue arising for consideration is whether the suspension order has been passed by the competent authority or not. This Court has not stayed the departmental enquiry, therefore, interim order does not require the respondent to stay departmental enquiry. Learned counsel for the petitioner could not dispute that after passing of interim order, suspension order has not been implemented, but he has paid full salary.

In view of the above, the contempt petition is misconceived in law and therefore, dismissed.
