Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 12/12/2017

1. Heard the petitioner's father Dr.Anil Khakhariya.

2. He submits that the petitioner is a table tennis player and has represented respondent No.1 in various State and National tournaments under the category of sub junior table tennis. He further submits that respondent No.2 under the chairmanship of respondent No.3 organized league tournament between top

16 players of each category after 2 state ranking and 1 championship after the league of cadet and sub junior respondent No.2 illegally and arbitrarily made the impugned selection list of sub junior boys irrespective of clear rules stated by respondent No.5 and the International Federation of Table Tennis and various other national and international sports federation.

3. Prayer has been made for quashing the selection list of sub junior boys Annexure P/1 and further prayed for direction to respondent No.2 to send new list according to the rule of respondent No.5 and also prayed for removal of respondents No.3 and 4.

4. I have heard the contentions on the question of admission.

5. In the selection list Annexure P/1, 26 players have been listed, none of them have been impleaded as party respondents in the writ petition. Once they have been selected, they have right to be heard and selection list cannot be quashed in absence of their impleadment as party respondents in the writ petition and without hearing them. Even otherwise, no legal and valid ground has been raised by the petitioner in the writ petition for declaring the said selection list as illegal and null and void. Likewise, there is no ground available in the writ petition for directing removal of respondents No.3 and 4 from the post of President, Chhattisgarh Table Tennis Sangh, Raipur and Chairman, Technical Committee, Chhattisgarh Table Tennis Association respectively.

6. I do not find any merit in this writ petition. The writ petition deserves to be and is hereby dismissed. However, the petitioner is at liberty to make a representation to respondent No.5 for redressal of her grievances in accordance with law, which shall be considered and decided by them expeditiously without being influenced by this order.
