Advocate General Hon'ble Shri Justice Pritinker Diwaker Order On Board 21/05/201 The applicant has field this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody in connection with Crime No. 205/2017 registered at Outpost Rampur, P.S. Kotwali, Korba, District Korba (CG) for the offence punishable under Sections 420, 467, 468, 471 r/w 34 of IPC.

As per the prosecution case, the applicant misused the password of computer for misappropriating the salary amounting Rs.4,50,000/-. 3.

Counsel for the applicant submits that the applicant is in jail since 11.11.2017, charge sheet has already been filed and the offences are triable by Magistrate. He further submits that the entire action was done by the applicant pursuant to the direction given by the senior officer and therefore, he alone cannot be held responsible.

On the other hand, counsel for the State opposes the bail application.

Considering the totality of the facts and circumstances of the case, particularly the detention period of the applicant, this Court is of the opinion that it is a fit case to release the applicant on bail. 6.

Accordingly, the application for grant of bail is allowed and the accused/applicant is directed to be released on bail on his furnishing a personal bond of Rs.2,00,000/- with one surety for the like sum to the satisfaction of the concerned Magistrate for his appearance before it as and when directed.
