This fourth application for grant of bail has been repeated mainly on the ground that even after lapse of 3 years, trial has not been concluded. 2.

The applicant has been charged for commission of heinous offence of murder but at the same time, entitled to speedy trial. This Court has to take into notice the extra ordinary pandemic situation, due to which, trial has been delayed. However, the case is of allegation of murder. In order to strike balance, instead of grant of bail, it would be proper to direct the Trial Court to conclude the trial on top priority basis. The concerned Trial Court shall give top priority if there is no other trial pending before it where the accused are in jail for more than 3 years and 3 months. All attempt shall be made to conclude the trial within a period of four months from the date of receipt of copy of this order.
