After hearing the preliminary arguments, this Court is not inclined to enlarge the applicant on anticipatory bail. At this stage, learned counsel for the applicant submits that he wants to withdraw the bail application with liberty to surrender and apply for regular bail before the trial Court on the ground that similarly placed co-accused have been granted bail.
Accordingly, this bail application for grant of anticipatory bail is dismissed as withdrawn.
The petitioner, if so advised, may surrender and apply for regular bail before the trial Court and if such application is filed, the trial Court shall consider and decide the same on merits as early as possible preferably on the same day.
