Learned State counsel, upon instructions from respondent No.2, submits that as the petitioner would be surplus in the institution where he has been transferred by the State Government, his joining has been kept in abeyance.

As the order has been passed by the State Government, unless the order is stayed, varied, modified or cancelled, the same is required to be executed. Therefore, in these circumstances, the respondents No.2 to 5 to comply with the State Government's order. Let the order be complied with allowing the petitioner to join. This order, however, shall not come in the way of the State Government in passing any other order which is permissible under the law.

The petition is accordingly disposed off.
