1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.5/2021 registered in Police Station Chando, District Balrampur-Ramanujganj for offence under Section 366 & 376 of the IPC.

2. The applicant has committed forcible sexual intercourse with the prosecutrix at about 7.30 pm on 4.1.2021 when she had gone out of her house to attend the nature's call. The prosecutrix is a married lady aged about 30 years and as per her own version of the incident, a villager namely Avtar Pannu had seen the occurrence. Moreover, there is delay of 4 days in lodging the FIR.

3. Considering the quality of evidence and the fact that the applicant is in jail since 10.1.2021 and charge sheet has already been filed, I am inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
