NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 6393 of 2016 • Smt. Godawari Verma W/o Shri Radhe Shyam Verma, Aged About 54 Years Presently Working As Supervisor, Integrated Child Development Project, Bhilai, Sector Marauda, District Durg (Chhattisgarh) ---- Petitioner

Versus

1. State Of Chhattisgarh Through: The Secretary, Women & Child Development Department, Mahanadi Bhawan, Mantralaya, New Raipur, District Raipur, (Chhattisgarh)

2. Director, Women & Child Development Department, Indravati Bhawan, Block-1, 2nd Floor, New Raipur, District Raipur, (Chhattisgarh)

3. Rishi Banjare, District Project Officer, Women & Child Development Department, Durg, District Durg, (Chhattisgarh)

4. District Project Officer, Women & Child Development Department, Bemetara, District Bemetara, (Chhattisgarh) ---- Respondents --------------------------------------------------------------------------------------------------- For Petitioner : Mr. Tarun Dadsena, Advocate For State : Mr. D.R. Minj, Dy. Government Advocate --------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 24/11/2016 1.

After arguing for sometime, learned counsel for the petitioner confines his prayer only to the extent that respondents may be directed to again consider her request for transfer to Bhilai Sector - 1 on the ground that petitioner's husband is working as an employee in Bhilai Steel Plant.

2.

Earlier a writ petition was filed by the petitioner challenging the transfer order passed in the year 2014, which was disposed off on 25.07.2014 directing consideration of representation. Upon consideration of representation, the respondents, on 25.09.2014, posted the petitioner at Integrated Child Development Project, Sector Nawagarh - 1, District Bemetara. Thereafter, the petitioner was placed on suspension vide order dated 22.10.2014 and later on suspension order was revoked on 02.06.2016 and posted the

petitioner at Integrated Child Development Project, Bhilai-1, District Durg. Thereafter, impugned order dated 10.11.2016 was passed again directing that the petitioner should join at Integrated Child Development Project, Sector Nawagarh - 1, District Bemetara. 3.

It appears that as the husband of the petitioner is posted in Bhilai Steel Plant, the petitioner is always insisting to remain posted nearby Bhilai. This aspect has already been considered by this Court and by the respondents while deciding the representation, therefore, I am not inclined to direct the respondents to consider the petitioner's representation in this present season. However, once the petitioner has remained posted at different place and complete normal tenure of posting, the State may consider whether, subject to administrative exigency, the petitioner may be posted nearby Bhilai as and when occasion arises for transfer of the petitioner after completion of normal tenure of posting at Integrated Child Development Project, Sector Nawagarh - 1, District Bemetara.

4.

With the aforesaid observation/direction the petition is finally disposed off.
