Mr. Anil S. Pandey, Govt. Advocate, for the State. This is an application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection with Crime No.253/2014 registered at P.S. Pandri, District Raipur (C.G) for the offence punishable u/s 420, 467, 468, 471/34 IPC.

As per the prosecution case, on the pretext of providing job in the railway department, the accused alongwith other accused Malkam Verma has received amounts to the tune of Rs.9,50,000/- from different complainants and thereafter, he gave them false appointment letters which were found to be forged. Learned counsel for the applicant submits that the main allegations are against the Malkam Verma who was the main instrument in the entire case. He further submits that the charge sheet has been filed and therefore, applicant may be enlarged on regular bail.

Per contra, learned State Counsel opposes the bail application and submits that the bail application of other co-accused has been rejected.

Having regard to the fact that the bail of the other co-accused has been rejected and similar allegations are

levelled against the applicant that he received the amounts from different complainants amounting to Rs.9,50,000/- on the pretext of providing jobs in the department of Railways and thereafter false appointment letters were issued to them, I am not inclined to release the applicant on bail.
