Justice Vimla Singh Kapoor, Order On Board 02.06.2021 This is the first bail application filed under Section 439 Cr.PC for grant of bail to the accused/applicant who is in prison in connection with Crime No. 111/2021 registered at Police Station Civil Lines, Raipur for the offence punishable under Section 20 (B) of the NDPS Act. 2.
According to the case of prosecution, on 03.03.2021 the accused/applicant was found in possession of 4 KG of Ganja without there being any document showing her authorization over the same like receipt, bill etc.

Having heard counsel for the rival parties, considered the facts and circumstances of the case and the material collected by the prosecution, and also keeping in mind the quantity of the contraband allegedly found in possession of the accused/applicant which comes to around 4 KG, and also considering the fact that the applicant is woman, this Court is of the opinion that it is a fit case to release her on bail.

Accordingly, the application is allowed. It is directed that on her furnishing a personal bond of Rs. 25,000/- with two sureties for the like sum to the satisfaction of the concerned Court, the applicant shall be released on bail. The applicant shall appear before the Court concerned as and when so directed.
