Apprehending arrest in connection with crime no.50/2017 registered at P.S. Baikunthpur, Distt. Korea (C.G) for the offences punishable u/ss 376, 294, 506 of IPC & section 66, 66(ga), 67(Kha) of Information Technology Act, the applicant has filed this application u/s 438 of the Code of criminal Procedure.

As per the prosecution case, a report was made by the prosecutrix that the present applicant on several occasions has committed forcible sexual intercourse which was videographed and the clips were kept by him and subsequently on the pretext to make them viral, further exploitation was continued and eventually the report was made on 07.02.2017. Learned counsel for the applicant submits that the entire statement of the prosecutrix would show that she was a consenting party, therefore, the applicant may be admitted to anticipatory bail.

Per contra, learned state Counsel opposes the bail

application.

Perused the report of prosecutrix as also her statement. Considering her report, I am not inclined to allow this bail application. Accordingly it is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
